Please read these Terms of Service carefully before making a pre-order purchase on the ASCNDX website. By completing a purchase, you confirm that you have read, understood, and agreed to these Terms.

1. About ASCNDX

ASCNDX is a pre-launch platform for an upcoming mobile application that will include AI-powered face analysis, personalized body workout programs, and skincare routine tools. The ASCNDX website currently serves as a pre-order platform only. The application itself has not yet been released.

2. What You Are Purchasing

By completing a pre-order through the ASCNDX website, you are purchasing early access to the ASCNDX application upon its future release. You are not purchasing a finished or currently available product. Your pre-order price is locked at the rate displayed at the time of your purchase. ASCNDX reserves the right to change pre-order pricing at any time and to set a different price for the application upon launch. Your locked rate applies to pre-order access only and does not extend to any in-app subscriptions, purchases, or pricing once the application has launched. ASCNDX will make commercially reasonable efforts to develop and release the application, though no specific release date is guaranteed.

We make no guarantee that any specific feature described on the website — including but not limited to face analysis, workout programs, or skincare tools — will be included in the final release of the application. Features may change, be modified, or be removed prior to or after launch.

3. Estimated Delivery

ASCNDX does not guarantee a specific launch date for the application. Timelines are estimates and may change due to development, regulatory, or other unforeseen circumstances. We will notify pre-order customers of any significant changes to the expected timeline via the email address provided at checkout.

4. Refund Policy

4.1 Standard Refunds

Pre-order purchases are eligible for a full refund if requested within 14 days of the original purchase date. To request a refund, contact us at official@ascndx.app with your order details.

4.2 EU Consumer Right of Withdrawal

If you are located in the European Union, you have the right to withdraw from this purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive. To exercise this right, notify us at official@ascndx.app before the 14-day period has expired. By completing your purchase, you may be asked to waive this right in order to receive immediate access to any pre-order benefits. If no immediate digital benefit is delivered, the right of withdrawal applies in full.

4.3 Non-Delivery Refunds

If the ASCNDX application is permanently cancelled and never released, all outstanding pre-order customers will be entitled to a full refund. We commit to notifying customers promptly in such an event and processing refunds within 30 days. For the purposes of this section, "permanent cancellation" means a public written announcement by ASCNDX, posted on the official website or sent by email to pre-order customers, explicitly stating that the application will not be developed or released.

4.4 No Refund After Launch

Once your 14-day refund window has expired, your purchase is non-refundable under all circumstances. The launch of the ASCNDX application does not affect your refund eligibility — the 14-day window runs from your original purchase date regardless of when the application is released. After this window has closed, no refunds will be issued for any reason.

5. Payment Processing

All payments are processed by Paddle (Paddle.com Market Limited), our authorized merchant of record. By completing a purchase, you also agree to Paddle's terms of service and privacy policy. ASCNDX does not directly store or process your payment card information.

Paddle handles all applicable taxes including VAT, GST, and sales tax based on your location. The final price displayed at checkout includes all applicable taxes.

6. Account and Access

Upon launch of the ASCNDX application, your pre-order will be linked to the email address used at checkout. You will be required to create an account using that email address to access your pre-order benefits. ASCNDX reserves the right to suspend or terminate access to accounts that violate these Terms or engage in prohibited conduct.

All content on the ASCNDX website and within the ASCNDX application — including but not limited to the brand name, logo, design, text, graphics, and software — is the exclusive property of ASCNDX and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any ASCNDX content without prior written consent.

9. Disclaimer of Warranties

The ASCNDX website and any information provided therein are offered on an "as is" and "as available" basis. ASCNDX makes no warranties, express or implied, regarding the accuracy of any information on the website, the suitability of the planned application for any particular purpose, or that the website will be uninterrupted or error-free.

Face analysis features described are planned and have not been medically validated. Results produced by any AI analysis feature within the future application should not be treated as medical, dermatological, or professional advice.

10. Limitation of Liability

To the fullest extent permitted by applicable law, ASCNDX and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the ASCNDX website or your pre-order purchase. Our total aggregate liability to you shall not exceed the amount you paid for your pre-order.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel. Any disputes arising under or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Israel, without prejudice to any mandatory consumer protection rights you may hold in your country of residence.

If you are located in the EU, nothing in these Terms limits your rights under applicable EU consumer protection law, including your right to bring a claim before the courts of your member state of residence.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify pre-order customers by email. Your continued use of the ASCNDX website after such notification constitutes your acceptance of the updated Terms.
